By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform. ## 1. Eligibility You must be at least 18 years old, or have permission from a parent or legal guardian if allowed by applicable law, to use the Platform. By using the Platform, you represent that the information you provide is accurate and that you are legally able to accept these Terms. ## 2. Our Platform L.O.L.A. is a digital platform designed to help clients and beauty professionals connect and manage skincare-related relationships and services. Depending on your role, the Platform may allow you to: - create an account and profile; - search for or connect with beauty professionals or clients; - book, manage, reschedule, or cancel appointments; - send and receive messages; - complete onboarding or skincare intake forms; - receive product recommendations; and - manage profile, scheduling, and communication preferences. We may change, suspend, or discontinue features at any time. ## 3. Accounts You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree not to share your account, impersonate another person or business, or provide false information. We may suspend or terminate accounts that violate these Terms. ## 4. Client and Beauty Expert Roles L.O.L.A. currently supports client accounts and beauty expert accounts. If you register as a beauty expert, you represent that the information you provide about your services, business, background, and offerings is accurate and lawful. Beauty experts are solely responsible for the services they provide, the statements they make, and their interactions with clients. ## 5. No Medical Advice L.O.L.A. is not a medical provider. The Platform does not provide medical advice, diagnosis, or treatment. Any skincare information, intake forms, recommendations, product suggestions, content, or communications on the Platform are for informational and business coordination purposes only and are not a substitute for professional medical advice. Always consult a licensed healthcare provider for medical concerns. If you believe you are experiencing a medical emergency, call 911 or your local emergency services immediately. ## 6. Appointments and Services The Platform may allow users to schedule and manage appointments. L.O.L.A. does not guarantee the availability, quality, legality, safety, or outcome of any service or provider. Unless expressly stated otherwise, L.O.L.A. is not a party to the service agreement between a client and a beauty expert. Any dispute relating to appointments, cancellations, no-shows, deposits, service quality, pricing, refunds, or outcomes is between the client and the beauty expert. ## 7. Messaging and Communications The Platform may include in-app messaging and service-related communications by email or other channels. You agree not to use the Platform to send unlawful, abusive, fraudulent, threatening, or spam communications. By creating an account, you consent to receive transactional communications such as verification emails, password reset emails, appointment-related notices, and essential service messages. ## 8. Product Recommendations and Content The Platform may display product information or recommendations. L.O.L.A. does not guarantee that any product is suitable for your skin, health, or personal needs. You are responsible for reviewing ingredients, warnings, and usage instructions before use. ## 9. User Content You may submit profile information, messages, intake responses, notes, and other content ("User Content"). You retain ownership of your User Content, but you grant L.O.L.A. a non-exclusive, worldwide, royalty-free license to use, host, store, display, and process that content as needed to operate and improve the Platform. You are solely responsible for your User Content and represent that you have the right to submit it. ## 10. Prohibited Conduct You agree not to: - use the Platform for unlawful purposes; - attempt unauthorized access to accounts or systems; - interfere with Platform performance or security; - upload malicious code; - harass, abuse, or exploit other users; - submit false or misleading information; or - use the Platform in a way that harms L.O.L.A. or other users. ## 12. Intellectual Property The Platform, including its software, branding, design, text, graphics, and logos, is owned by or licensed to L.O.L.A. and protected by law. You may not copy, distribute, reproduce, reverse engineer, or create derivative works from the Platform without our written consent. ## 13. Third-Party Services We may use third-party providers for hosting, email delivery, analytics, authentication, and infrastructure. We are not responsible for third-party services, and your use of those services may be subject to their own terms and policies. ## 14. Future Paid Features Some features may become paid, premium, subscription-based, or transaction-based in the future. If paid services are offered, additional pricing and billing terms may apply. ## 15. Termination We may suspend or terminate your access to the Platform at any time if you violate these Terms, create risk to the Platform or other users, or if we discontinue the service. ## 16. Disclaimers THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. ## 17. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, L.O.L.A. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITY ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE PLATFORM OR THESE TERMS WILL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US IN THE PRIOR 12 MONTHS. ## 18. Indemnification You agree to indemnify and hold harmless L.O.L.A. and its affiliates, personnel, and service providers from claims, losses, liabilities, and expenses arising from your use of the Platform, your User Content, your services, or your violation of these Terms. ## 19. Governing Law These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles. App Store Terms If you access L.O.L.A. through the Apple App Store or another app marketplace, you acknowledge that these Terms are between you and L.O.L.A., not the marketplace operator, and that your use must comply with the applicable app store rules. ## 21.
