Terms of Service Terms of Service Effective Date: May 15th, 2026 These Terms of Service ("Terms") govern your access to and use of the L.O.L.A. mobile application, related websites, and connected services (collectively, the "Services") operated by Lola May LLC ("L.O.L.A.," "we," "us," or "our"). By creating an account, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services. Eligibility You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. By using L.O.L.A., you represent that you meet this requirement and that the information you provide is accurate. The Services L.O.L.A. is a beauty marketplace and business management platform that helps: clients discover beauty professionals, view profiles, message, and request or manage appointments; and beauty professionals manage profiles, services, clients, intake information, messages, product recommendations, and subscriptions. L.O.L.A. provides software tools and a connection platform. Unless expressly stated otherwise, Lola May LLC is not the provider of the underlying beauty services offered by independent beauty professionals through the platform. Accounts You are responsible for: maintaining the confidentiality of your login credentials; all activity that occurs under your account; keeping your account information accurate and current. You may not: impersonate another person or business; create an account using false or misleading information; share your account in a way that compromises security or violates these Terms. Client Terms As a client, you agree that: you will provide accurate booking and profile information; you will use the Services only for lawful, legitimate personal booking and communication purposes; you are responsible for reviewing the profile, services, availability, and suitability of any beauty professional you choose to contact or book; any appointment, service, or outcome is ultimately between you and the beauty professional, except where the law provides otherwise. Beauty Professional Terms As a beauty professional, you agree that: you are solely responsible for the services you advertise, schedule, or provide; you will provide accurate information about your identity, qualifications, services, pricing, availability, and policies; you will comply with all applicable laws, licensing rules, health and safety requirements, tax obligations, and professional standards related to your business; you will not misrepresent your credentials, work, products, or results; you are responsible for communications, appointment management, and the content you publish through your account. Lola May LLC does not guarantee leads, bookings, earnings, or business outcomes. Appointments, Messaging, and Platform Interactions The Services may allow users to send messages, share intake information, and request, confirm, edit, or cancel appointments. You agree not to use the Services to: harass, threaten, stalk, or abuse others; send spam, deceptive, or unlawful communications; share content that is defamatory, obscene, discriminatory, infringing, or otherwise unlawful; misuse another user's personal information. We may remove content or restrict accounts that violate these Terms or our community standards. Photos, Profiles, and User Content You may upload profile images, product images, text, and other content ("User Content"). You retain ownership of your User Content, but you grant Lola May LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and distribute that content as needed to operate, improve, and promote the Services. You represent that: you own or have the necessary rights to the User Content you submit; your User Content does not violate any law or third-party right; your User Content is accurate and not misleading. We may remove User Content that violates these Terms, our policies, or applicable law. L.O.L.A. Pro Subscriptions Certain features for beauty professionals may require a paid subscription, including L.O.L.A. Pro. If you purchase a subscription through the iOS app: the purchase is processed by Apple through the App Store; billing, renewals, cancellations, and refunds are generally governed by Apple's terms and policies; subscriptions may automatically renew unless cancelled in accordance with Apple's settings and rules; free trials, introductory offers, renewals, and subscription availability may vary by account, jurisdiction, or platform. We may change subscription features, pricing, or availability to the extent allowed by law and platform rules. No Medical Advice L.O.L.A. is not a medical platform and does not provide medical advice, diagnosis, or treatment. Content in the Services, including profile information, service descriptions, intake forms, recommendations, or communications, is provided for informational and operational purposes only. If you have a medical concern, allergy, skin condition, or urgent health issue, consult a qualified medical professional. No Warranty Regarding Third-Party Services Beauty professionals using L.O.L.A. are independent businesses or individuals. We do not endorse, certify, warrant, or guarantee: the quality, safety, legality, suitability, or outcome of any third-party service; the truth or completeness of user-generated profiles, portfolios, or messages; uninterrupted availability of any user's services or appointments. Your interactions and disputes with other users are primarily between you and that user, except where applicable law provides otherwise. Acceptable Use You agree not to: use the Services for unlawful purposes; interfere with or disrupt the Services or related systems; reverse engineer, scrape, exploit, or attempt unauthorized access to the Services; upload malware, harmful code, or content intended to damage systems or users; use the Services in a way that infringes intellectual property, privacy, publicity, or other rights. Suspension and Termination We may suspend, restrict, or terminate access to the Services at any time if we believe you have: violated these Terms; created risk for users, the platform, or our business; engaged in fraud, abuse, or unlawful conduct. You may stop using the Services at any time. Termination does not automatically eliminate obligations that arose before termination. Intellectual Property The Services, including software, branding, text, graphics, logos, designs, and platform features, are owned by or licensed to Lola May LLC and are protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or exploit any part of the Services without prior written permission. Disclaimers THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. LOLA MAY LLC DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, secure, error-free, or that defects will always be corrected. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOLA MAY LLC AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF: THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE; OR ONE HUNDRED U.S. DOLLARS (USD $100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Indemnification You agree to defend, indemnify, and hold harmless Lola May LLC and its affiliates, owners, officers, employees, contractors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to: your use of the Services; your User Content; your violation of these Terms; your violation of any law or the rights of another person. Governing Law These Terms are governed by the laws of Arizona, without regard to conflict of law principles, except to the extent superseded by applicable consumer protection law. Changes to These Terms We may update these Terms from time to time. If we make material changes, we may provide notice through the Services, by updating the Effective Date, or by other appropriate means. Your continued use of the Services after an update becomes effective means you accept the revised Terms.
